Terms of Service

These Terms of Service ("Terms") govern your access to and use of myPoolFlow ("we," "us," or "our") software and services, including our website (mypoolflow.com), our web application at app.mypoolflow.com, and our mobile applications (including the Android package com.poolflow.poolflow_app). By using myPoolFlow, you agree to these Terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.

Our Privacy Policy describes how we collect and use information and is incorporated by reference where applicable.

The service

myPoolFlow provides tools for pool service businesses to schedule routes, log visits, manage teams, communicate with staff, and work with customer and pool information. Features may change over time as we improve the product. We strive for reliability but do not guarantee uninterrupted or error-free operation.

Accounts and access

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. You must provide accurate registration information and keep it up to date. We may suspend or terminate access that violates these Terms or poses a risk to the service or other users.

Subscriptions, fees, and billing

myPoolFlow is offered on a free tier and several paid subscription tiers. The current plans, the pool counts they include, and the prices in U.S. dollars are listed at mypoolflow.com/pricing. Prices and pool caps in effect at the time of purchase apply to your subscription unless we notify you of a change.

Free tier. The Free tier is offered without charge for accounts within its pool cap. We may change or discontinue the free tier on reasonable notice.

Auto-renewing subscriptions. Paid plans are billed monthly in advance and automatically renew at the same cadence for the same pool cap and price (plus any applicable taxes) until cancelled. By starting a paid plan you authorize us — or, for purchases made inside our iOS or Android apps, the relevant app store — to charge the payment method on file at the start of each billing cycle. Renewal occurs unless you cancel before the end of the current cycle. The renewal date and price are shown in the app under Settings → Billing and, for App Store purchases, in your Apple ID subscription settings.

Plan changes and pool counts. You can upgrade or downgrade at any time from Settings → Billing. Stripe prorates the change for the remainder of the current billing cycle. Active pools (and spas) count against your tier cap; suspended customers and historical records do not. If your active pool count exceeds the cap of your current tier, we may prompt you to upgrade and, after notice, restrict creation of new pools or block writes that would push you further over the cap until you upgrade.

Purchases through the Apple App Store and Google Play. When you start a subscription from inside our iOS or Android app, the purchase is processed by the app store and is also governed by that store's standard terms (Apple's Standard EULA for App Store purchases, and the Google Play Terms of Service for Play purchases). Your subscription automatically renews through the app store at the price shown at purchase unless you turn off auto-renew at least 24 hours before the end of the current period in your Apple ID or Google Play account settings. Refund requests for App Store or Play purchases are handled by Apple or Google under their respective policies; we are not able to issue refunds on those transactions directly.

Customer payments through Stripe Connect. myPoolFlow lets you take card and ACH payments from your own customers (work order deposits, recurring auto-charge, saved cards). Those funds settle to your own Stripe account and are subject to Stripe's pricing and Connected Account Agreement. myPoolFlow does not take an application fee or mark up Stripe's processing rate. You are responsible for tax collection, refunds, chargebacks, and disputes related to charges you initiate to your customers.

Taxes. Subscription fees are exclusive of any sales, use, VAT, GST, or similar taxes, which are your responsibility unless we are required by law to collect and remit them. We may add such taxes to your invoice where applicable.

Failed payments and suspension. If a charge fails, we (or the app store, where applicable) may retry the charge. If the issue is not resolved within a reasonable period after notice, we may downgrade your account to the Free tier or restrict access to paid features until the balance is paid.

Cancellation and refunds. You may cancel a paid plan at any time from Settings → Billing (or, for App Store purchases, from your Apple ID subscription settings; for Play purchases, from your Google Play account). Cancellation takes effect at the end of the current billing period; you keep access to paid features until then. Except where required by law, fees already paid are non-refundable and we do not provide partial-period refunds for unused time. We may, at our discretion, offer pro-rata credits for material service outages.

Price changes. We may change subscription prices. We will provide at least 30 days' notice before a price change applies to your renewals (by email and/or in-app notice). If you do not agree to the new price, you may cancel before the change takes effect; continuing to use the paid plan after the effective date constitutes acceptance of the new price.

Acceptable use

You agree not to:

  • Use the service in violation of law or to transmit unlawful, harmful, or deceptive content;
  • Attempt to gain unauthorized access to our systems, other accounts, or data you are not permitted to access;
  • Interfere with or disrupt the integrity or performance of the service (including excessive or abusive automated access);
  • Reverse engineer or attempt to extract source code from the software except where prohibited restrictions are not enforceable under applicable law.

Your content

You retain ownership of data and content you submit. You grant us the rights reasonably necessary to host, process, back up, and display that content to provide the service to you and, where applicable, to users you authorize (for example, your team). You are responsible for the content you upload and for obtaining any consents required from individuals whose information you store in the product.

Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnity

You will defend and indemnify us and our affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your content, your use of the service, or your violation of these Terms, except to the extent caused by our willful misconduct.

Termination

You may stop using the service at any time. We may suspend or end access to the service with reasonable notice where practicable, or immediately if we reasonably believe continued use would cause harm. Provisions that by their nature should survive will survive termination.

Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and revise the effective date. If changes are material, we will provide additional notice as appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.

General

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
